USA Entertainment Ventures LLC ("USAEV," "we," "our," or "us"), a wholly owned operational subsidiary of DAKDAN Worldwide (CAGE Code 9W3P6), operates the USAEV.press AI-powered press release production and distribution platform, USAEV.co enterprise media supply platform, Fanz.us sports social media network, and an integrated portfolio of vertical digital media properties, FAST streaming channels, podcast networks, political communications infrastructure, and associated enterprise software-as-a-service offerings (collectively, the "Platform" or "Services").
This Privacy Policy governs the collection, processing, storage, transfer, disclosure, and deletion of all personal data, enterprise data, behavioral data, media consumption data, advertising data, and any other information obtained through your use of any USAEV Service.
2. Data Controller Identification
For purposes of applicable data protection law, USA Entertainment Ventures LLC acts as both a Data Controller (with respect to data we collect directly) and a Data Processor (with respect to enterprise customer data we process on behalf of our business clients).

- Payment information (processed via Stripe; we do not store full card numbers)

Part II: Terms of Service & Platform Use Agreement
13. Acceptance of Terms
These Terms of Service ("Terms"), together with all other Parts of this Compendium incorporated herein, constitute a binding legal agreement between you ("User," "Client," "Subscriber," or "Enterprise") and USA Entertainment Ventures LLC governing your access to and use of all USAEV Services.
You must be at least 18 years of age to create an account or access any USAEV Service. By registering for or using the Services, you represent and warrant that you meet these eligibility requirements.
14. Account Registration and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify USAEV of any unauthorized access or suspected security breach at legal@usaev.co.
15. Description of Services
USAEV.press
AI-powered press release drafting, formatting, scoring, and multi-channel distribution platform. Features include AP-style AI formatting, SEO and AEO optimization, AI-generated media assets, LLM distribution, wire service distribution, and multi-platform syndication.
USAEV.co
Enterprise media supply platform providing news outlets and digital publishers with AI-scored, publish-ready story packages and media asset bundles.
16. User Conduct and Prohibited Activities
You agree not to use any USAEV Service to:
- Submit false, misleading, fabricated, or defamatory press releases or content
- Impersonate any person, organization, brand, or government entity
- Distribute content that infringes any third-party intellectual property right
- Transmit spam, unsolicited commercial communications, or content in violation of CAN-SPAM Act or TCPA
- Distribute malware, viruses, trojans, or any malicious code
- Circumvent, disable, or interfere with security features or access controls
- Scrape, crawl, harvest, or extract data from USAEV platforms without express written authorization
- Reverse engineer, decompile, disassemble, or attempt to derive source code from any USAEV Service
18. Fees, Billing, and Payment Terms
Service fees are set forth in your applicable subscription plan, enterprise agreement, or insertion order. All fees are in US Dollars unless otherwise specified. Payment is processed via Stripe, Inc. All fees are non-refundable except as expressly provided in your enterprise agreement or required by applicable law.
19. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR TITLE.
Part IV: Binding Arbitration Agreement & Class Action Waiver
26. Agreement to Arbitrate
YOU AND USA ENTERTAINMENT VENTURES LLC ("USAEV") AGREE THAT ANY AND ALL DISPUTES, CLAIMS, OR CONTROVERSIES ARISING OUT OF OR RELATING TO THESE TERMS WILL BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION, RATHER THAN IN COURT.
This agreement to arbitrate is governed by the Federal Arbitration Act (FAA), 9 U.S.C. ยง 1 et seq., and will be interpreted broadly.
28. Class Action Waiver
YOU AND USAEV AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.
31. Pre-Arbitration Notice and Informal Resolution
Before initiating arbitration, you must provide USAEV written notice of your Dispute by sending a detailed demand letter to legal@usaev.co. The parties agree to negotiate in good faith for 60 days to attempt to resolve the Dispute informally before initiating arbitration.
Part V: Intellectual Property, Trademark & Proprietary Rights Policy
34. Ownership of USAEV Technology
All technology, software, code, algorithms, AI pipelines, models, training methodologies, scoring systems, distribution engines, workflow automations, database schemas, API architectures, and all derivative works thereof are the exclusive intellectual property of USA Entertainment Ventures LLC and/or DAKDAN Worldwide.
35. Trademark Rights
The following marks are trademarks or service marks of USA Entertainment Ventures LLC or DAKDAN Worldwide: USAEV, USAEV.press, USAEV.co, DAKDAN, DAKDAN Worldwide, Fanz.us, and all associated logos, taglines, and brand identifiers.
37. Anti-Competitive Use Prohibition
You expressly represent and warrant that you are not accessing USAEV Services for the purpose of developing a competing platform, benchmarking for competitive intelligence, or replicating USAEV's technology stack or distribution relationships.
Part VI: Advertising, Media Buying & Campaign Compliance Terms
41. FTC Compliance
All advertising content must comply with the Federal Trade Commission Act and FTC Guides. Sponsored content must be clearly labeled as 'Sponsored,' 'Advertisement,' or 'Promoted.' AI-generated content must be disclosed where required.
42. Political Advertising Compliance
Political advertising must include all required 'paid for by' disclaimers pursuant to FEC regulations. You are solely responsible for compliance with federal and state election laws, including state disclaimer requirements and FCC political broadcasting rules.
43. Prohibited Categories
USAEV will not distribute advertising in the following categories:
- Tobacco, e-cigarettes, vaping products
- Illegal firearms or weapons
- Controlled substances or illegal drugs
- Adult content or sexually explicit material
- Hate speech or discriminatory content
- Multi-level marketing pyramid schemes
- Fraudulent investment schemes
Part VII: Children's Privacy & COPPA Compliance
46. Age Restrictions
USAEV Services are not directed to children under the age of 13 in the United States or under the age of 16 in the European Economic Area and United Kingdom. We do not knowingly collect personal information from children below the applicable age threshold without verifiable parental consent.
47. COPPA Compliance
Pursuant to the Children's Online Privacy Protection Act (COPPA), USAEV does not knowingly collect personal information from children under 13, does not target advertising to children under 13, and will delete any personal information discovered to have been collected from a child upon discovery.
48. UK Age Appropriate Design Code
USAEV's compliance with the UK Children's Code includes age-appropriate default settings with the highest privacy protections, no collection of geolocation data from minors beyond what is strictly necessary, and no deceptive design patterns.
Part VIII: Data Processing Addendum (DPA)
50. Scope and Application
This Data Processing Addendum governs the processing of personal data by USAEV on behalf of enterprise clients. Where USAEV processes personal data on behalf of an enterprise client, USAEV acts as a Data Processor and the enterprise client acts as the Data Controller.
51. Processing Obligations
When acting as a Data Processor, USAEV agrees to process personal data only on documented instructions from the Controller, ensure confidentiality, implement appropriate security measures, respect conditions for engaging sub-processors, and assist with Data Subject rights requests.
Part IX: DMCA & Copyright Policy
55. DMCA Safe Harbor
USAEV complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. ยง 512. We respect the intellectual property rights of others and maintain policies and procedures for DMCA safe harbor protection.
56. Designated DMCA Agent
All DMCA-compliant takedown requests must be sent to: dmca@usaev.co
59. Repeat Infringer Policy
USAEV will terminate the accounts of users who are the subject of multiple valid DMCA takedown notices, consistent with our obligations under 17 U.S.C. ยง 512(i).
Part X: Anti-Scraping & Competitive Intelligence Prohibition
60. Prohibition on Automated Data Extraction
You are strictly prohibited from using any automated tool, script, bot, crawler, spider, or data harvesting application to access, extract, copy, monitor, or aggregate any data from USAEV Services without express written authorization.
62. Prohibition on Reverse Engineering
You may not reverse engineer, decompile, disassemble, decode, or otherwise attempt to derive the source code, underlying architecture, algorithm logic, or any other non-public technical information from any USAEV Service.
63. Legal Remedies
Violations may constitute federal crimes under the Computer Fraud and Abuse Act (CFAA), violations of the Economic Espionage Act, and misappropriation of trade secrets under the DTSA.
Part XI: Communications Law & FCC Compliance Policy
65. CAN-SPAM Act Compliance
All commercial email communications comply with the CAN-SPAM Act. USAEV will include a valid physical postal address, provide a clear opt-out mechanism, honor opt-out requests within 10 business days, and use truthful subject lines.
66. TCPA Compliance
Automated communications via text or telephone must comply with the Telephone Consumer Protection Act. Prior express written consent is required for autodialed or prerecorded calls/texts to wireless numbers.
67. FCC Political Broadcasting
Content distributed through USAEV FAST streaming channels must comply with FCC public interest obligations, including equal opportunities rule, reasonable access for qualified candidates, and sponsorship identification requirements.
Part XII: Television, Streaming & FAST Channel Compliance Policy
69. FAST Channel Operations
USAEV operates or supplies content to 24/7 Free Ad-Supported Streaming Television (FAST) channels distributed on Roku, Amazon Fire TV, Pluto TV, Samsung TV Plus, and other connected television platforms via MRSS-based automated distribution.
70. Video Privacy Protection Act
USAEV's FAST channel and streaming operations comply with the Video Privacy Protection Act (VPPA), 18 U.S.C. ยง 2710. USAEV does not disclose personally identifiable information about viewers' video content consumption to third parties without informed written consent.
71. Content Standards
Content submitted for FAST channel distribution must comply with FCC indecency standards, platform-specific content policies, USAEV's Acceptable Use Policy, and FTC native advertising disclosure requirements.
Part XIII: Indemnification, Limitation of Liability & Disclaimers
74. Indemnification
You agree to indemnify, defend, and hold harmless USAEV and DAKDAN Worldwide from any claims, demands, actions, liabilities, losses, damages, or expenses arising from your use of Services, content you submit, violation of these Terms, or infringement of third-party rights.
75. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, USAEV SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION.
76. Performance Disclaimers
USAEV expressly disclaims any warranty regarding press release pickup rates, LLM citation frequency, FAST channel viewership, advertising campaign performance, or political advertising effectiveness. All distribution data is provided for informational purposes only.
Part XIV: General Provisions, Amendments & Contact Information
78. Governing Law
This Compendium and all disputes are governed by the laws of the State of Delaware, without regard to conflict of laws principles. Litigation shall be brought exclusively in federal or state courts located in Wilmington, Delaware.
80. Amendments
USAEV reserves the right to modify this Compendium at any time. Material changes will be posted with a revised Effective Date. For material changes that adversely affect your rights, USAEV will provide at least 30 days' advance written notice.
86. U.S. Government Contracting
To the extent USAEV Services are procured by or on behalf of the U.S. Government, they are provided as 'commercial items' as defined in FAR 2.101. USAEV's SDVOSB status (CAGE Code 9W3P6) is maintained in accordance with SBA regulations.
